Terms of Use and EULA
These terms apply when you download or use Petalphone. Petalphone is provided by Rida Melkaoui, Morocco. Questions, complaints, and claims can be sent to ridamelkaouiofficial@gmail.com.
Your license
Petalphone is licensed, not sold. You receive a personal, limited, non-transferable, non-exclusive license to use the app for private, non-commercial play on devices you own or control, subject to the rules of the store where you downloaded it. You may not copy, sell, sublicense, reverse engineer, modify, distribute, or misuse the app, except where applicable law expressly allows it.
Apple App Store terms
For an Apple download, Apple's Standard Licensed Application End User License Agreement applies and is part of these terms. These terms are between you and Rida Melkaoui, not Apple. Rida Melkaoui, not Apple, is responsible for Petalphone and its content, maintenance, support, warranties, legal compliance, product claims, and intellectual property claims.
Apple has no duty to provide support. If Petalphone fails to meet an applicable warranty, you may notify Apple and Apple may refund the app purchase price, if any. To the fullest extent allowed by law, Apple has no other warranty duty. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the Apple-related terms after you accept them.
Your Apple license is limited to Apple-branded products you own or control and use permitted by the Apple Media Services Usage Rules, including Family Sharing or volume purchasing where allowed. You must also follow applicable third-party agreements, including your mobile data agreement.
Legal compliance
You confirm that you are not located in a country subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on a United States government prohibited or restricted party list. Do not use Petalphone for unlawful, threatening, abusive, or infringing content.
Your prompts and drawings
You are responsible for custom prompts, names, guesses, and drawings made on your device. This content stays on the device unless you choose to show or share it outside the app. You keep ownership of your content. You must have the right to use anything you enter.
Full Garden
Full Garden is an optional, non-consumable in-app purchase. It unlocks the features listed on the purchase screen for the store account used to buy it. The store shows the final local price before you confirm. Apple or Google processes payments, refunds, and store account rules. Restore purchase is available in the app. Full Garden does not expire, but access can depend on a valid store receipt and the continued availability of store services.
Ownership
Petalphone, its artwork, code, writing, name, and other included materials belong to Rida Melkaoui or their licensors. These terms do not transfer those rights to you.
Maintenance, availability, and ending this license
We may update the app to fix problems, improve compatibility, or meet store and safety rules. We cannot promise that every feature will always work on every device. You may end this license by deleting the app. Your license ends automatically if you materially break these terms. Sections that should reasonably continue, including ownership, warranty, liability, and claims, remain effective.
Warranty and responsibility
To the fullest extent allowed by law, Petalphone is provided as is and as available, without implied guarantees of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Consumer rights that cannot legally be excluded still apply.
Rida Melkaoui, not Apple or Google, is responsible for addressing claims about Petalphone, including product liability, legal or regulatory compliance, consumer protection, privacy, and intellectual property. To the fullest extent allowed by law, we are not liable for indirect, incidental, special, or consequential loss caused by using or being unable to use the app. Nothing here limits liability where the law does not allow it.
Governing law
These terms are governed by the laws of Morocco, without removing any mandatory consumer rights that apply where you live. Apple's Standard EULA separately states the law that applies to your relationship with Apple.
Changes and contact
